WHAMMO — TERMS OF SERVICE
Last updated: October 2026
These terms apply to Whammo ("the Game") on Android and iOS and to its online services. By playing the Game you agree to them. If you do not agree, do not play.
1. WHO WE ARE
The Game is operated by DigiLabs, a sole trader (eenmanszaak) established in Belgium. Our full registration and contact details are set out in section 15 at the end of these terms.
2. YOUR LICENCE TO PLAY
We give you a personal, non-exclusive, non-transferable and revocable licence to download and play the Game on devices you own or control, for your own non-commercial entertainment. The Game, its content and its software remain ours or our licensors'.
If you downloaded the Game from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies; these terms add to it. Apple is not responsible for the Game, its content, maintenance or support, and has no obligation to provide them.
3. ACCOUNTS
When you first play, the Game creates a guest account tied to your device. If you uninstall the Game or change devices without linking an email address or a Google or Apple account under Settings, your progress may be lost and we may not be able to recover it. Keep your sign-in details secure; you are responsible for activity on your account. One person per account — do not sell, share or transfer accounts.
The Game needs an internet connection.
4. VIRTUAL CURRENCY AND ITEMS
Gems, gold, shards, summon keys, energy, chests, heroes, pets, gear and other in-game items are part of the Game's content. You receive a licence to use them in the Game; you do not own them. They have no monetary value, cannot be exchanged for real money, goods or services, and cannot be sold or transferred to another account. We may adjust in-game items, prices and rewards to keep the Game balanced and fair, and we may correct items received through an error or a bug.
5. PURCHASES AND YOUR RIGHT OF WITHDRAWAL
You can buy gems, the Starter Bundle (once per account), the Premium Battle Pass (once per season), certain heroes and Guild Charters with real money. Prices are shown in the Game before you buy. Purchases are made through the Apple App Store or Google Play, which act as the seller and handle billing and refunds under their own terms. Heroes and the Starter Bundle stay on your game account permanently; gems, the Battle Pass and Guild Charters are used up as you use them.
As a consumer in the European Union you have a statutory 14-day right of withdrawal for digital content, which you may lose once delivery has begun with your express consent — items you buy are delivered to your account immediately. Nothing in these terms affects your mandatory statutory rights. Refund requests should be made to the store you bought from (reportaproblem.apple.com, or Order history in Google Play).
6. SUMMONS (RANDOMISED ITEMS)
The Summon feature gives items chosen at random. The exact odds for every tier and every item are shown in the Game behind the ? button on the Summon page before you pull, together with the guarantees that apply (for example a guaranteed Epic or better within every 10 pulls). Every pull made with gems asks you to confirm first. Summons can also be made with summon keys, which are earned by playing and are never sold, and with a free pull unlocked by watching an ad.
Where the law of your country restricts paid randomised items, we restrict them too: in Belgium, summons cannot be made with gems. Items obtained from a summon are virtual items under section 4.
7. ADVERTISING
The Game shows optional rewarded ads. The reward is granted when the ad finishes. Ads depend on availability and we do not guarantee that one will always be available.
8. GUILDS AND PLAYER CONDUCT
We have zero tolerance for objectionable content and abusive players. Display names, guild names and guild mottos must not be offensive, hateful, sexual, threatening, impersonate another person or organisation, or contain personal information about anyone. Guild messages are chosen from a fixed list, so there is no free-text chat.
You can report a player or a guild by emailing us with the display name or guild name. We review reports promptly and may rename content, remove a player from a guild, disband a guild, or suspend or terminate an account that breaks these rules.
9. FAIR PLAY
You agree not to cheat. In particular, do not use modified clients, bots, scripts or automation; do not exploit bugs or glitches (report them to us instead); do not interfere with our servers or other players' accounts; and do not reverse-engineer the Game except where the law permits it. We may remove items, currency or rankings gained in breach of this section, and suspend or terminate accounts involved.
10. CHANGES TO THE GAME AND AVAILABILITY
We update the Game regularly and may add, change or remove features, events and content. The online services may occasionally be unavailable for maintenance. If we ever decide to shut the Game down, we will announce it in the Game in advance and give reasonable notice.
11. SUSPENSION AND TERMINATION
You may stop playing and ask us to delete your account at any time (see our account deletion page). We may suspend or terminate your access if you seriously or repeatedly break these terms. Where we do, and where the law requires it, we will tell you why. Deleting an account removes its virtual items, which cannot be restored.
12. AGE
Whammo is not directed at children under 13. If you are under the age of majority in your country, you need a parent or guardian's permission to play and to make purchases.
13. LIMITATION OF LIABILITY
The Game is provided "as is" and "as available", to the fullest extent permitted by law. We are not liable for indirect or consequential losses, or for losses caused by events outside our reasonable control.
Nothing in these terms excludes or limits our liability where it cannot be excluded or limited under mandatory Belgian or European Union law. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for gross negligence or wilful misconduct. If you are a consumer, your mandatory statutory rights — including the legal guarantee of conformity for digital content — are not affected by these terms.
14. GOVERNING LAW AND DISPUTES
These terms are governed by Belgian law. If you are a consumer resident in the European Union, this choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
If you are a consumer and we cannot resolve a complaint directly, you may contact the Belgian Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur), North Gate II, Koning Albert II-laan 8 bus 1, 1000 Brussels — www.consumerombudsman.be.
